This Privacy Policy describes how your personal data is processed by Reclamadatos, S.L. (hereinafter, "Dataguardian"), through the platform www.dataguardian.eu (hereinafter, the "Platform").

What personal data do we process?

The personal data that you provide to us through the services offered on the Platform:

  • "Find out who has your personal data" service: name and surname, email address, language preference, profile picture and list of domain names of senders who have sent you an email (e.g. @entity.com).
  • "Claim your RGPD rights" service: name and surname, email, language preference, profile picture, identity document, age, telephone number and signature.
  • Service "Claim your RGPD rights": name and surname, email, language preference, profile picture, identity document, age, telephone number and signature.
  • "Contact" service: name and surname, email address and reason for contact.

The aforementioned personal data are obligatory in order to attend to your request or provide the service requested, so that refusal to provide them will make it impossible to attend to the request and/or, where appropriate, to provide the service requested.

In the event that you provide third party data, you declare that you have the consent of the third party and undertake to provide them with the information contained in this Privacy Policy, exempting Dataguardian from any liability. In any case, Dataguardian may carry out periodic verifications to ascertain this fact, adopting the due diligence measures that correspond in accordance with the applicable regulations.

For what purposes?

Dataguardian will process your personal data for the following purposes, unless your email provider sets additional limits:

  1. In the event that you decide to contract the services offered on the Platform, for the execution, control and management of the provision of the services;
  2. In the event that you request information through the "Contact" form, in order to process and attend to your request, as well as to provide you with the best possible service; and
  3. In the event that you do not object by completing the "Claiming your GDPR rights" form, to inform you by email about new developments in the Dataguardian services.

Legitimation

The legal bases for processing your personal data for the purposes described above are as follows, unless your email provider sets additional limits:

  1. In the event that you decide to contract the services offered on the Platform: the execution of the contractual relationship with you (art. 6.1b RGPD).
  2. In the event that you request information through the "Contact" form: the execution of the contractual relationship with you, or the adoption of pre-contractual measures if you are not yet a customer (art. 6.1b RGPD).
  3. In the event that you do not object, to send you electronic commercial communications referring to similar data claim services to those that you had initially contracted (art. 21.2 LSSI) through the "Claim your RGPD rights" service of the Platform.

With whom do we share your personal data?

At Dataguardian we are fully committed to complying with applicable data protection laws and respecting your privacy. Except as provided below, and unless your email provider sets additional limits, Dataguardian will not share your personal data with third parties.

For illustrative purposes only, Dataguardian may be required by law to disclose your data to the Public Administration and other bodies of a jurisdictional nature.

Likewise, in order to comply with the "Claim your rights under the GDPR" service, we may disclose your data to entities against which you wish to exercise your rights and, where appropriate, to the Data Protection Authority.

Additionally, we inform you that for the provision of the services, Dataguardian has contracted its virtual infrastructure according to a "cloud computing" model through AWS, providing the appropriate guarantees of protection required by the RGPD by subscribing to the Model Contract Clauses adopted by the European Commission."

How long do we keep your data?

At Dataguardian we will keep your personal data to provide or carry out the services requested (unless you indicate otherwise through the means indicated in the section "Your rights") and we will keep it for the necessary limitation periods according to the legislation applicable in each case to meet future liabilities, up to a maximum of 5 years, unless your e-mail provider establishes Additional limits..

Additional limits

In the event that you have signed up to reclaimdata via your Google-managed email account, Google restricts third parties from using its API tool to access your Google Account information ("Your Google User Data").

Notwithstanding any other provision of this Policy, if you provide us with access to the following categories of "Your Google User Data" in order to provide the Dataguardian services, Dataguardian's use of such data will be subject to these additional restrictions:

  • At Dataguardian we will only use access to read the "header From" of Gmail messages (e.g. @reclamadatos.es) if you have requested the "Find out who has your data" service.
  • We will not transfer this data from your Google Account to third parties, unless it is necessary to provide and improve these features, comply with applicable law or in the context of a business transaction (e.g. merger, acquisition or sale of assets).
  • We will not transfer this data to third parties.
  • At Dataguardian we will not use this data from your Google Account for ad serving.
  • At Dataguardian we will not allow individuals to read this data unless: (i) you expressly authorise us to do so for specific messages; (ii) it is necessary for security purposes such as investigating bugs or abuse; (iii) to comply with applicable law; or (iv) for Dataguardian' internal operations, provided that the data (including derivatives) has been aggregated and anonymised.

The Platform may include, display or display links to other websites for your convenience and information. These websites may operate independently of us. These linked sites may have their own privacy policies, which we strongly encourage you to read when you visit them. To the extent that any linked websites you visit are not owned or controlled by us, we are not responsible for the content of such websites, their use or their privacy practices.

Your rights

You can exercise your rights of access, rectification, opposition, deletion, limitation of processing or portability of your data by sending your request through the following form, addressed to the Privacy Office. You can also modify your preferences regarding the sending of electronic commercial communications at any time by accessing the My profile section of your Dataguardian account.

In the event that we breach our data protection obligations, you have the right to lodge a complaint with the Spanish Data Protection Agency.

Update

This Policy may be updated periodically to reflect changes in our processing of personal data.
